Terms & Conditions

These terms govern use of our website and voluntary donations made to Food on Wheels.

Policy Details

1. About Food on Wheels

Food on Wheels is a registered charitable trust in India. We run charitable programmes focused on food assistance, education, outreach, and support for children, families, and communities in need.

These Terms & Conditions apply to https://www.foodonwheels.in, its donation pages, contact forms, and related services (together, the “Website”). “Food on Wheels”, “we”, “us”, and “our” refer to the trust. “You” and “donor” refer to a visitor or person making a donation.

2. Acceptance and eligibility

By using the Website or making a donation, you agree to these Terms & Conditions, our Privacy Policy, and our Cancellation & Refund Policy. If you do not agree, please do not use the Website or make a donation.

  • You must be at least 18 years old and legally capable of entering into a binding agreement, or use the Website under the supervision of a parent or legal guardian.
  • You must provide information that is accurate, current, and complete.
  • You may use only a payment method that you are authorised to use and funds obtained from lawful sources.
  • Donations must comply with all laws applicable to you and to Food on Wheels.

3. Nature and use of donations

A payment made through the donation page is a voluntary charitable contribution. It is not a purchase of goods or services and does not give the donor any ownership interest, benefit, or right to direct our day-to-day activities.

Unless we expressly agree otherwise in writing for a specific campaign, donations may be applied to the charitable objects and programmes of Food on Wheels wherever the need is greatest. We do not sell products, operate a marketplace, or ship goods through this Website.

4. Donation amount, charges, and taxes

You choose the donation amount before authorising payment. Amounts shown on the Website are in Indian Rupees (INR). Food on Wheels does not add a platform or convenience fee to the amount selected by you. Your bank or payment provider may apply its own charges under its terms.

A donation does not automatically qualify for a tax deduction. Any tax benefit is subject to applicable law, the trust’s eligibility, and the donor providing the information and documents required for a valid receipt. Donors should obtain independent tax advice where necessary.

5. Payment processing

Payments may be processed by third-party payment gateways, UPI applications, banks, and payment networks, including PhonePe where enabled. Those providers process payments under their own terms and privacy notices. Food on Wheels is responsible for the donation purpose and donor support; the payment provider is responsible for its payment-processing service.

  • The Website does not ask for or store your UPI PIN, OTP, CVV, full card number, or online-banking password.
  • A donation is treated as received only after the payment provider confirms a successful transaction to us.
  • A pending, failed, or declined payment is not a completed donation. Please verify the final status in your bank or payment application before trying again.
  • We may decline, hold, or refund a donation where reasonably necessary for fraud prevention, sanctions compliance, legal compliance, or correction of a payment error.

6. Acknowledgements and donation receipts

You may request a donation acknowledgement or eligible receipt by contacting us with your name, contact details, donation date, amount, and transaction reference. We may request additional details required by applicable law. A payment confirmation from a bank or payment application is not, by itself, a tax-exemption certificate.

7. Cancellations, failed payments, and refunds

Completed donations are generally final because they are voluntary contributions used for charitable activities. Exceptional refund requests, duplicate payments, unauthorised transactions, and failed-payment reversals are handled under our Cancellation & Refund Policy. That policy states the eligibility criteria and processing timelines.

8. Acceptable use

  • Do not use the Website for fraud, money laundering, unlawful fundraising, impersonation, harassment, or any activity prohibited by law.
  • Do not interfere with the Website, introduce malicious code, attempt unauthorised access, scrape personal data, or disrupt payment processing.
  • Do not misrepresent an association with Food on Wheels or use our name, logo, photographs, or content to solicit funds without written permission.

9. Intellectual property and external links

The Website’s branding, text, graphics, photographs, and other content are owned by or licensed to Food on Wheels and may not be copied or commercially used without permission, except as allowed by law.

Links to third-party websites and payment services are provided for convenience. We do not control their content, availability, security, or privacy practices. Your use of a third-party service is governed by that provider’s terms.

10. Availability and limitation of liability

We aim to keep the Website accurate and available, but we do not guarantee uninterrupted or error-free access. Programme information, photographs, statistics, and availability may change as our work develops.

To the maximum extent permitted by law, Food on Wheels will not be liable for indirect, incidental, or consequential loss arising from use of the Website or a third-party payment service. Nothing in these terms excludes liability that cannot lawfully be excluded or limits your rights under applicable law.

11. Privacy

Our Privacy Policy explains what personal data we collect, why we use it, when we share it, how long we retain it, and how you may exercise your rights. Payment credentials are entered directly with the relevant payment provider and are not stored by Food on Wheels.

12. Changes to these terms

We may update these terms to reflect changes in our services, payment methods, or legal obligations. The revised version will be posted on this page with a new “Last updated” date. Changes apply from the date they are posted and do not alter a completed donation retrospectively.

13. Governing law and disputes

These terms are governed by the laws of India. Subject to any mandatory consumer forum or other jurisdiction available under applicable law, disputes relating to the Website or donations will be subject to the courts having jurisdiction in Kozhikode, Kerala.

Please first contact our Grievance Officer using the details on the Contact & Grievance page. We acknowledge complaints within 2 business days and aim to resolve them within 15 business days. If a matter depends on a bank, payment provider, or another external party, we will explain the dependency and provide updates.
